Terms of Service

Please read these terms carefully before using Portsmouth Lawn Mowing services. By engaging our lawn care services, you agree to be bound by these terms and conditions.

1. Service Agreement Overview

Portsmouth Lawn Mowing ("Company," "we," "us," or "our") provides professional lawn mowing, grass cutting, and related lawn maintenance services ("Services") to residential and commercial properties in Portsmouth, Virginia and surrounding areas. This Terms of Service Agreement ("Agreement") constitutes a legally binding contract between you ("Customer," "you," or "your") and Portsmouth Lawn Mowing.

By requesting a quote, accepting an estimate, or authorizing us to perform Services on your property, you acknowledge that you have read, understood, and agree to be bound by all terms, conditions, and policies outlined in this Agreement. If you do not agree to these terms, please do not engage our Services.

2. Liability Limitations

Portsmouth Lawn Mowing maintains comprehensive general liability insurance and workers' compensation coverage. However, our liability is limited as follows:

  • Our maximum liability for any single incident or claim is limited to the total amount paid by Customer for Services during the twelve (12) months preceding the incident.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages arising from or related to our Services, including but not limited to loss of profits, data, or business interruption.
  • Portsmouth Lawn Mowing is not responsible for damage to underground utilities, sprinkler systems, cables, or other subsurface installations unless Customer has explicitly marked their location prior to our arrival.
  • We are not liable for damage caused by acts of nature, severe weather, or circumstances beyond our reasonable control.
  • Customer assumes all responsibility for personal property left on the lawn or in the service area, including toys, decorations, and outdoor furniture.

3. Payment Terms and Conditions

Payment for Services is due according to the following terms:

  • Pricing: All pricing is provided in writing via a free estimate. Estimates are valid for thirty (30) days from the date of issue.
  • Payment Methods: We accept cash, check, credit card, debit card, and electronic bank transfers. Payment information will be securely processed.
  • Invoicing: Invoices are issued after each service visit or according to the agreed-upon billing schedule (weekly, bi-weekly, or monthly).
  • Payment Due Date: Payment is due within seven (7) business days of invoice date unless alternative arrangements have been made in writing.
  • Late Payments: Invoices not paid within thirty (30) days will incur a late fee of 1.5% per month (18% annually) or the maximum rate permitted by Virginia law, whichever is lower.
  • Suspension of Services: If payment is more than fifteen (15) days overdue, Portsmouth Lawn Mowing reserves the right to suspend Services until payment is received in full.
  • Price Adjustments: Prices may be adjusted with thirty (30) days' written notice to account for changes in fuel costs, equipment maintenance, labor, or market conditions.

4. Cancellation Policy

Customers may cancel Services at any time without penalty or long-term contract obligation. The following cancellation terms apply:

  • Cancellation Request: Cancellation requests must be submitted in writing via email to info@portsmouthlawnmowing.com or by phone at (804) 804-9906 at least forty-eight (48) hours before your scheduled service.
  • Same-Week Cancellations: Cancellations requested with less than forty-eight (48) hours' notice may incur a cancellation fee equal to fifty percent (50%) of the scheduled service cost.
  • Seasonal Suspension: Customers may suspend Services for up to thirty (30) days without penalty. Suspensions longer than thirty (30) days are treated as cancellations.
  • Final Invoice: Upon cancellation, Customer is responsible for payment of all Services rendered through the cancellation date.
  • Service Termination: Portsmouth Lawn Mowing reserves the right to terminate Services if Customer violates this Agreement or fails to provide reasonable access to the property.

5. Customer Responsibilities

To ensure safe and effective service delivery, Customer agrees to:

  • Provide safe and unobstructed access to the lawn and service areas.
  • Disclose any hazards, obstacles, or special conditions (e.g., pets, underground utilities, delicate plants) that may affect service delivery.
  • Ensure all pets are secured indoors or in a separate enclosure during service visits.
  • Mark or identify the location of underground utilities, sprinkler systems, cables, and other subsurface installations.
  • Remove personal property, toys, decorations, and obstacles from the lawn prior to scheduled service.
  • Maintain accurate contact information and notify us of any changes to phone number, email, or service address.
  • Pay invoices in a timely manner according to agreed-upon payment terms.

6. Property Access Requirements

Customer grants Portsmouth Lawn Mowing and its authorized employees and contractors ("Service Personnel") the right to access your property for the purpose of performing Services. This access includes:

  • Access to all areas of the lawn and yard where Services are to be performed.
  • Use of driveways and walkways for equipment access and parking.
  • Access to water sources if needed for equipment rinsing or lawn care applications.
  • Customer must provide gate codes, unlock gates, or arrange alternative access methods as needed.
  • Service Personnel will respect Customer's privacy and property, entering only areas necessary to perform Services.
  • If Customer denies access to the property, Portsmouth Lawn Mowing reserves the right to charge a service call fee and reschedule the visit.

7. Weather-Related Clauses

Weather conditions significantly impact lawn mowing service quality and safety. The following weather-related provisions apply:

  • Rain and Wet Conditions: Services may be postponed if grass is saturated or wet, as mowing wet grass can cause damage to lawn health and create unsafe working conditions. We will automatically reschedule to the next available dry window.
  • Extreme Heat: Services may be rescheduled or modified during heat advisories to protect the health and safety of our crews.
  • Snow and Ice: Winter services are suspended when snow, ice, or freezing conditions make lawn care unsafe or ineffective.
  • High Winds: Services may be postponed during high wind conditions that create safety hazards for equipment operation.
  • Notification: Portsmouth Lawn Mowing will notify Customer as soon as possible if weather conditions require rescheduling.
  • No Service Charge: Weather-related postponements do not incur service charges; Services are simply rescheduled to the next suitable date.

8. Dispute Resolution Process

In the event of a dispute or disagreement regarding Services or billing, the following resolution process applies:

  • Initial Contact: Customer must contact Portsmouth Lawn Mowing within seven (7) days of the incident or disputed charge via email (info@portsmouthlawnmowing.com) or phone ((804) 804-9906) with a detailed description of the issue.
  • Investigation: Portsmouth Lawn Mowing will investigate the claim within five (5) business days and respond to Customer with findings and proposed resolution.
  • Mediation: If Customer is unsatisfied with the initial response, both parties agree to attempt informal mediation to resolve the dispute.
  • Binding Arbitration: Any dispute that cannot be resolved through mediation shall be settled by binding arbitration in accordance with the American Arbitration Association (AAA) rules, with proceedings held in Portsmouth, Virginia.
  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

9. Service Quality Standards

Portsmouth Lawn Mowing commits to delivering high-quality, professional lawn mowing services. Our quality standards include:

  • Mowing grass to the agreed-upon height and maintaining consistent cutting patterns.
  • Edging along driveways, sidewalks, and flower beds for a professional appearance.
  • Removal or mulching of grass clippings according to Customer preference.
  • Arrival within the scheduled time window on the agreed-upon service day.
  • Professional, courteous conduct by all Service Personnel.
  • Cleaning of equipment before service to prevent cross-contamination of weeds or diseases.

10. Insurance and Liability Coverage

Portsmouth Lawn Mowing maintains the following insurance coverage:

  • General Liability Insurance: Comprehensive general liability coverage protecting against property damage and bodily injury claims.
  • Workers' Compensation: Full workers' compensation coverage for all employees and contractors.
  • Equipment Insurance: Coverage for all lawn care equipment and machinery used in service delivery.

Customers may request proof of insurance coverage at any time. Insurance does not cover damage caused by Customer negligence or failure to disclose hazards.

11. Modifications to Terms

Portsmouth Lawn Mowing reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website or notification to Customer via email. Continued use of Services after modifications constitutes acceptance of the updated terms. For significant changes, we will provide at least thirty (30) days' written notice.

  • You have read and understand these Terms of Service in their entirety.
  • You agree to be bound by all terms, conditions, and policies outlined herein.
  • You have the legal authority to enter into this Agreement on behalf of yourself or your organization.
  • You authorize Portsmouth Lawn Mowing to perform Services on your property.
